Europe: Are Antitrust Agencies Focusing on the Medical Device Industry?

The pharmaceutical industry in the European Union (EU) has undergone critical scrutiny by national antitrust agencies over the last few years. Most prominently, in January 2008, the European Commission launched a wideranging inquiry into the conditions of competition in the pharmaceutical sector.1 The European Commission believes there are some indications of commercial practices by pharmaceutical companies that are intended to restrict competition.
