US Supreme Court to Consider Overtime Pay For Pharmaceutical Reps

Posted 28 November 2011 | By

The US Supreme Court agreed this week to decide whether pharmaceutical-sales representatives are covered by federal overtime-pay requirements. The court agreed to hear an appeal by two former sales reps for GlaxoSmithKline PLC, who are seeking overtime pay on behalf of a nationwide class of representatives employed by the drug maker.  Glaxo said the lower-court rulings in its favor were correct, but nevertheless, it joined the plaintiffs in asking the Supreme Court to hear the case. Lower courts have issued conflicting rulings on whether drug representatives should receive overtime pay, and Glaxo said the pharmaceutical industry needs "a clear and uniform answer" on the issue.
